Mind View New York Mental Health Counseling, PLLC, doing business as MindView Therapy, together with its affiliated companies including MindView Therapy, LLC (Indiana) and its licensors (“Company,” “we,” “us,” or “our”), respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.
This Privacy Policy describes the types of information we may collect from you, or that you may provide, when you visit or use mindviewtherapy.com (the “Website”) and any products or services offered on or through the Website (collectively, the “Services”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.
This Privacy Policy applies to information we collect:
- On this Website and through the Services.
- In email, text, and other electronic messages between you and us or the Website.
- Through any mobile or desktop applications you download from this Website.

Relationship to HIPAA and Our Notice of Privacy Practices
MindView Therapy is a healthcare provider. Health information that we create, receive, or maintain about you in connection with providing treatment, obtaining payment for treatment, or our healthcare operations is “Protected Health Information” (PHI) governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and our separate Notice of Privacy Practices.
This Privacy Policy applies only to information that is NOT PHI under HIPAA, such as general information collected through the Website from visitors, prospective clients, and the public. If any information we collect is PHI, our Notice of Privacy Practices governs that information and controls over any conflicting statement in this Privacy Policy.
Most clinical and treatment-related information is handled inside our electronic health record and client portal system, which is separate from this Website and subject to our Notice of Privacy Practices and applicable business associate agreements.
Consumer Health Data
Some information we collect may relate to your physical or mental health even when it is not PHI under HIPAA. We treat information that could reveal a health condition or your interest in mental health services as sensitive. We do not sell this information, and we do not share it with third parties for their own advertising or marketing purposes. Residents of certain states may have additional rights regarding consumer health data (see “Your State Privacy Rights”).
Children Under the Age of 18
Our Website and Services are intended for adults eighteen (18) years of age and older. No one under eighteen (18) may provide any information to or on the Website or Services. We do not knowingly collect personal information from anyone under eighteen (18). If we learn we have collected personal information from a person under eighteen (18) without verified parental consent, we will delete it. If you provide your mobile number and opt in, we may send you text messages related to your care and our Services, such as appointment reminders, scheduling, billing notices, and, if you separately consent, informational or promotional messages from MindView Therapy.
- Consent is not a condition of receiving services or of any purchase.
- Message frequency varies.
- Message and data rates may apply.

- You can review this Privacy Policy at any time, and our SMS terms in our Terms of Use.
Mobile Information Sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with, sold to, or transferred to any third parties. We do not sell your mobile number or your text messaging opt-in data. Your mobile number and opt-in data are used only to deliver the messages you have consented to receive, including through the messaging service providers who transmit messages on our behalf and who are prohibited from using this information for any other purpose.
Standard carrier message and data rates apply, and carriers are not liable for delayed or undelivered messages.
How We Share Your Information
We may disclose aggregated or de-identified information without restriction. We may disclose personal information as described in this Privacy Policy. Notwithstanding anything in this section, text messaging originator opt-in data and consent are never shared with, sold to, or transferred to any third parties or affiliates for marketing or promotional purposes, and the sharing categories below exclude that information except as needed for our messaging service providers to deliver messages on our behalf (see “Text Messaging (SMS) Program”):
- To our subsidiaries and affiliates for the purposes described here.
- To contractors, service providers, and other third parties who support our business and Website, who are bound by contractual obligations to protect your information and use it only for the purposes for which we disclose it to them. Where these parties handle PHI, they do so under a business associate agreement.

Selling and Sharing of Personal Information
We do not sell your personal information for money, and we do not share your personal information with third parties for their own cross-context behavioral advertising. We do not share health-related information with third parties for their marketing or advertising purposes.
Third-Party Links and Services
The Website may contain links to third-party websites, plug-ins, and services, and may include content served by third parties. We do not control these third parties and are not responsible for their privacy practices. This Privacy Policy does not apply to them. We encourage you to read the privacy policy of every website you visit and every service you use.
Your Privacy Choices
We offer you the following choices about your information:
- Promotional communications: If you do not wish to receive promotional email or text messages from us, you can opt out by replying STOP to a text, using the unsubscribe link in an email, or emailing admin@mindviewtherapy.com. This does not affect communications necessary for your care, billing, or account.
- Cookies: You can set your browser to refuse some or all cookies, though some parts of the Website may not function properly.
- Third-party advertising: We do not control third parties’ collection or use of your information. Your State Privacy Rights
State consumer privacy laws may give residents additional rights over their personal information. The scope of these rights, the applicability thresholds, and the exceptions vary by state, and information that is PHI under HIPAA or otherwise exempt is generally not subject to these laws. Because much of the information we hold is exempt health information, some requests may be limited accordingly.
To exercise any of these rights, email admin@mindviewtherapy.com. We will verify your request as required by law and may ask for information to confirm your identity. You may use an authorized agent to submit a request where permitted. We will not discriminate against you for exercising your rights. If we deny your request, you may appeal by replying to our response or emailing admin@mindviewtherapy.com.
Nevada residents have a limited right to opt out of certain sales of personal information. You may submit a request to admin@mindviewtherapy.com. We do not currently sell personal information as defined by that law.
Data Security
We have implemented measures designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Information you provide is stored on secured systems, and payment transactions are encrypted.
The safety of your information also depends on you. Where you have chosen a password for access to any part of the Website or Services, you are responsible for keeping it confidential. Please do not share your password. Be cautious about sharing information in any public areas of the Website.
Unfortunately, no method of transmitting or storing information is completely secure. Although we work to protect your personal information, we cannot guarantee its security, and any transmission is at your own risk. We are not responsible for circumvention of any privacy settings or security measures on the Website.
Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to provide the Services, and to comply with our legal, regulatory, tax, accounting, and professional recordkeeping obligations, after which we delete or de-identify it. Retention of PHI is governed by our Notice of Privacy Practices and applicable law.
Do Not Track
Some browsers offer a “Do Not Track” signal. Because there is no common industry standard for responding to these signals, our Website does not currently respond to them. We do honor applicable universal opt-out mechanisms where required by law.
Changes to This Privacy Policy
It is our policy to post any changes to this Privacy Policy on this page. If we make material changes to how we treat your personal information, we will notify you through a notice on the Website home page, and, where we have your email address on file, by email. The date this Privacy Policy was last revised appears at the top of this page. You are responsible for periodically visiting this Privacy Policy to check for changes.
